Terms & Conditions
These terms govern your purchase from A Bead Shop. Please read them before ordering — by placing an order you accept them.
1. Who you are buying from
[COMPANY NAME] ([BUSINESS REGISTRATION NO.]), [ADDRESS], Hong Kong. Contact: [EMAIL].
2. Our products
Everything we sell is made from natural shell, pearl and stone. No two pieces are identical. Colour, pattern, banding and size vary from piece to piece, and screens render colour differently. Photographs show a representative example, not the exact piece you will receive, unless we say otherwise. This variation is a property of natural material and is not a fault.
3. Prices
All prices are in US dollars and exclude delivery, which is shown at checkout. Prices may change at any time, but a change will never affect an order we have already dispatched.
If a price is obviously wrong — a clear mistake in the figure — we are not obliged to sell at that price. We will contact you, and you may confirm at the correct price or cancel for a full refund.
4. Your order, and when the contract is made
This is important, so we set it out plainly.
When you place an order and pay, you are making us an offer to buy. Payment does not, by itself, form a contract, and does not oblige us to supply. We will send an acknowledgement confirming we have received your order — that acknowledgement is not an acceptance either.
A contract between us is formed only when we dispatch the goods, and it covers only the goods actually dispatched.
We may decline or cancel an order, in whole or in part, if:
- the piece has sold out or is no longer available;
- the piece cannot be made to the standard we require;
- there was an error in the price or description;
- we cannot deliver to your address, or delivery there is restricted;
- we reasonably suspect fraud.
If we cancel, we refund you in full, to your original payment method, without delay. We are not liable to you beyond that refund.
5. Stock and made-to-order pieces
Our pieces are handmade in small quantities, so stock can occasionally run out between you placing an order and us packing it. If that happens we will tell you, cancel the part of the order we cannot supply, and refund you in full for it.
Larger quantity orders are made to order and take approximately 3–4 weeks before dispatch. Once production of a made-to-order piece has begun it cannot be cancelled.
6. Delivery
We dispatch within 7 days when a piece is in stock. Delivery time after dispatch depends on the courier and the destination; we cannot control it and delivery estimates are not guarantees.
Delivery within Hong Kong is free. Delivery elsewhere is charged, and the cost is shown at checkout before you pay.
Risk in the goods passes to you on delivery. Any import duties, taxes or customs charges in the destination country are your responsibility, and we cannot tell you in advance what they will be.
Please give a full and correct delivery address, and collect your parcel when the courier or post office notifies you.
7. If a parcel comes back to us undelivered
A parcel is sometimes returned to us without ever being delivered. The usual reasons are:
- the courier or post office attempted delivery, left notice, and nobody collected it within their holding period;
- the address given was wrong or incomplete;
- the parcel was refused on arrival, often because of import duties or local charges.
In each of those cases the delivery has already been paid for and the parcel has to travel back to us at further cost. So when a parcel is returned to us we will contact you, and you may either:
- have it sent again — you pay the cost of the new delivery; or
- have it refunded — we refund the price of the goods, less the delivery cost already paid and the cost of the parcel being returned to us.
Import duties and local charges are your responsibility, so refusing a parcel because of them does not entitle you to a refund of delivery costs.
If you are a consumer with a statutory right to cancel, exercising that right is a different thing from refusing a parcel, and we will refund whatever the law requires in that case.
8. Returns
Set out in full on our Delivery & Returns page, which forms part of these terms. In summary: faulty, damaged or incorrect items may be returned within 14 days of delivery and we cover the return postage. We do not otherwise accept returns because you have changed your mind, except where the law gives you that right — which it does if you are a consumer in the EU or the UK.
Nothing in these terms affects your statutory rights in respect of goods that are faulty or not as described.
9. Where we sell
We do not sell to countries subject to trade sanctions or export restrictions that apply to us. If an order is placed for delivery to such a destination we will cancel it and refund you in full.
10. Our liability
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud.
Otherwise our total liability in connection with an order is limited to the amount you paid for it. We are not liable for loss of profit, loss of business, or any indirect or consequential loss. Nothing here affects the statutory rights of a consumer.
11. Using this website
The text, photographs and design of this site belong to us and may not be copied or reused commercially without our permission. Do not misuse the site or attempt to interfere with it.
12. Governing law
These terms are governed by the laws of Hong Kong, and the Hong Kong courts have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, nor of the right to bring proceedings there.
13. Changes
We may update these terms. The version in force is the one published when you place your order.
